TERMS OF SERVICE AND DONATION TERMS

These Terms of Service and Donation Terms (“Terms”) govern your use of www.titospromise.org, related donation forms and services operated by Tito’s Promise Inc.

By using the website, submitting information or making a donation, you agree to these Terms. If you do not agree, do not use the website.

1. About Tito’s Promise

Tito’s Promise Inc. (“Tito’s Promise,” “we,” “our,” or “us”) is a Florida not-for-profit corporation supporting charitable programs for children, families and underserved communities, including programs in Costa Rica.

2. Pending Federal Tax-Exempt Status

Tito’s Promise has applied to the Internal Revenue Service for recognition under Section 501(c)(3) of the Internal Revenue Code.

While the application is pending, donors do not have advance assurance that contributions are tax-deductible. If the IRS approves exemption for the period in which a contribution was made, the contribution may qualify as tax-deductible under applicable law.

We do not provide tax, accounting or legal advice. Donors should consult their own professional advisers regarding deductibility.

This section will be updated after the IRS issues its determination.

3. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to make a donation or enter a binding transaction through the website.

A minor may use the website only with the involvement and permission of a parent or legal guardian.

4. Donations

Donations are voluntary gifts to Tito’s Promise.

By submitting a donation, you represent that:

  • The information you provide is accurate.

  • You are authorized to use the selected payment method.

  • The donation does not violate any law.

  • The funds do not originate from unlawful activity.

  • You understand the intended charitable purposes described on the website.

Unless expressly accepted by Tito’s Promise in writing as a legally restricted gift, donations are considered unrestricted and may be used where the Board of Directors determines they are most needed, consistent with our charitable purposes.

Campaign descriptions, suggested designations and fundraising goals communicate our present intentions but do not necessarily create a legally enforceable restriction.

We may decline, return or refuse a donation when acceptance would be unlawful, inconsistent with our mission, administratively burdensome, subject to unacceptable restrictions or potentially harmful to Tito’s Promise.

5. Payment Processing

Payments may be processed through Stripe, PayPal or another provider displayed during checkout. Payment processors have separate terms and privacy policies.

Unless otherwise displayed, donations are processed in United States dollars.

You are responsible for any currency-conversion, bank, card or other charges imposed by your financial institution.

Some checkout services may invite donors to cover processing costs or make a separate optional contribution to the technology provider. Any separately identified contribution to a third-party platform is not a donation to Tito’s Promise and may be subject to that provider’s refund policy.

6. Recurring Donations

If you select a recurring donation, you authorize the payment processor to charge the selected payment method at the frequency and amount shown during checkout until canceled.

You may cancel a recurring donation through any cancellation feature provided in your receipt or donor portal or by emailing info@titospromise.org.

Cancellation stops future scheduled charges but does not automatically refund donations already processed. Submit cancellation requests sufficiently before the next scheduled charge to allow processing.

We may cancel or suspend a recurring donation if a payment fails, the payment method expires, fraud is suspected or continued processing is not reasonably possible.

7. Refunds and Transaction Errors

Charitable donations are generally final and nonrefundable to the extent permitted by law.

If you believe a donation was duplicated, unauthorized, entered for the wrong amount or otherwise processed in error, contact info@titospromise.org promptly and preferably within 30 days.

Refund requests will be reviewed individually. Approval is not guaranteed except where required by law. Refunds are normally returned to the original payment method.

Original processing fees or separate contributions paid to third-party platforms may not be recoverable.

8. Donation Acknowledgments

Donation confirmations may identify:

  • Tito’s Promise Inc.

  • The donation date and amount.

  • Whether goods or services were provided in exchange.

  • A description and good-faith estimate of goods or services when applicable.

  • The organization’s federal tax-exemption status at the time of the acknowledgment.

Unless specifically stated otherwise, no goods or services are provided in exchange for a donation.

Donors are responsible for maintaining records and determining the tax treatment of their contributions.

9. Restricted and Designated Gifts

We accept a legally restricted donation only through an express written agreement authorized by Tito’s Promise.

If an accepted restriction later becomes unlawful, impossible or impracticable, we may seek the donor’s consent or use the contribution as closely as reasonably possible to the donor’s original charitable intent, consistent with applicable law.

A donor may not retain control over donated funds, select an individual beneficiary or direct conduct that would be inconsistent with Tito’s Promise’s independent control and discretion.

10. International Charitable Activities

Tito’s Promise may use donated funds to support charitable programs, supplies, events, grants or assistance outside the United States, including in Costa Rica.

Tito’s Promise retains control and discretion over donated funds and program decisions. Donations are made to Tito’s Promise—not directly to foreign individuals, volunteers, vendors or beneficiaries.

International activities are subject to applicable United States and foreign laws, sanctions, anti-corruption requirements, banking restrictions and program safeguards.

Program schedules, beneficiaries, locations and methods may change based on need, safety, available funds, local conditions and legal requirements.

11. Fundraising Goals and Program Results

Fundraising goals, suggested donation impacts, timelines and program estimates are good-faith projections and are not guarantees.

Actual costs, participation and results may vary. Funds raised beyond a campaign’s immediate needs may be used for related charitable activities or other purposes consistent with Tito’s Promise’s mission, unless a written restriction requires otherwise.

12. Communications

By providing an email address, you consent to receive transactional communications relating to donations, receipts, security and requests you make.

If you separately subscribe to promotional communications, we may send program updates, fundraising appeals and event information. You can unsubscribe using the link in an email.

If you expressly consent to text messages:

  • Message frequency may vary.

  • Message and data rates may apply.

  • Consent is not a condition of donating.

  • Reply STOP to opt out.

  • Reply HELP for assistance.

  • Carriers are not responsible for delayed or undelivered messages.

13. Website Content

The website provides general information about Tito’s Promise, its history, mission and anticipated activities.

Content is provided for informational purposes and may be changed without notice. We do not guarantee that every statement will remain current, complete or error-free.

Nothing on the website constitutes legal, tax, accounting, financial, medical or professional advice.

14. Intellectual Property

Unless otherwise stated, the website’s text, design, logo, graphics, photographs, videos and other content are owned by or licensed to Tito’s Promise and are protected by applicable intellectual-property laws.

You may view and share links to public website pages for personal, informational and noncommercial purposes.

You may not reproduce, modify, sell, exploit or use our name, logo or content in a manner suggesting endorsement, sponsorship or affiliation without written permission.

Platform names and logos belong to their respective owners.

15. Submissions, Stories and Media

If you voluntarily submit a testimonial, story, photograph, video or other material for publication, you represent that:

  • You have the right to provide it.

  • It does not violate another person’s privacy or intellectual-property rights.

  • You have obtained necessary permission for identifiable individuals, including parental or guardian permission for minors.

Unless otherwise agreed in writing, you grant Tito’s Promise a nonexclusive, worldwide, royalty-free license to use, reproduce, edit and display the submitted material for charitable, educational and promotional purposes.

You may withdraw permission for future uses by contacting us, although withdrawal may not affect materials already printed, published or distributed.

16. Prohibited Conduct

You may not:

  • Use the website for unlawful, fraudulent or abusive purposes.

  • Attempt unauthorized access to systems or information.

  • Introduce malware or harmful code.

  • Interfere with website operation or security.

  • Impersonate another person.

  • Submit false or misleading information.

  • Violate another person’s rights.

  • Use automated methods to scrape or overload the website.

  • Misrepresent an affiliation with Tito’s Promise.

  • Use the donation process to test stolen payment credentials or launder funds.

We may block access, reject submissions or report suspected misconduct.

17. Third-Party Services and Links

The website may contain services, forms, videos or links provided by Wix, GoHighLevel, Stripe, PayPal, social-media platforms and other third parties.

We do not control and are not responsible for third-party availability, content, security, privacy practices or terms.

Use of a third-party service is governed by that provider’s terms.

18. Events, Volunteers and Promotions

Events, volunteer activities, raffles, contests, merchandise, scholarships or special programs may be governed by additional rules, releases, waivers or eligibility requirements.

If additional terms conflict with these Terms, the more specific terms govern that activity.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.”

Tito’s Promise disclaims implied warranties, including merchantability, fitness for a particular purpose, noninfringement and uninterrupted or error-free operation.

We do not guarantee that the website will always be secure, available or free from harmful components.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

20. Limitation of Liability

To the fullest extent permitted by law, Tito’s Promise and its directors, officers, employees, volunteers and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from use of the website.

Our total liability for a claim relating to the website or an online transaction will not exceed the amount you paid through the website during the 12 months preceding the event giving rise to the claim.

These limitations do not apply to liability that cannot legally be excluded or limited.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Tito’s Promise and its directors, officers, employees, volunteers and agents from claims, losses and reasonable expenses arising from your unlawful misuse of the website, breach of these Terms or violation of another person’s rights.

22. Governing Law and Disputes

These Terms are governed by Florida law, without regard to conflict-of-law principles.

Before filing a legal action, the parties agree to attempt in good faith to resolve the dispute by written notice and informal discussion for at least 30 days.

Unless applicable law requires otherwise, legal proceedings must be brought in a state or federal court located in Palm Beach County, Florida. Each party consents to the jurisdiction of those courts.

23. Severability and Waiver

If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

Failure to enforce a provision is not a waiver of the right to enforce it later.

24. Changes to These Terms

We may update these Terms to reflect changes in our operations, services or legal obligations.

Updated Terms will be posted with a revised effective date. Continued use of the website after an update constitutes acceptance of the revised Terms.

Changes will not retroactively alter an accepted written restriction on a donation.
